Theory and Practice: What Empirical Study Tells Us About the Future of the National Mediator Accreditation System (NMAS)
Two years after the introduction of the NMAS, it seems timely to reflect on whether the Standards, as a key indicator of what the industry regards as important in mediation in Australia, capture key aspects of mediation services and mediator competency as experienced by industry stakeholders, that is, those who have sought to interpret, implement or comply with the NMAS requirements, and who have been most impacted by their arrival.
The Australian Commercial Disputes Centre's (ACDC)5 empirical survey of mediation stakeholders addresses these fundamental questions. ACDC surveyed two hundred and twenty-six mediation participants – mediators, parties to the mediation and advisors/support people – in order to ascertain what those involved in mediation practice identify as important elements of the process and the important characteristics of mediators.
This paper examines the results of ACDC's survey to identify areas of agreement and divergence between the National Mediator Standards and participants and provides discussion on how these might impact on the future development and implementation of the Standards and the National Mediator Accreditation System. It is hoped that the discussion generated will assist the successor to the National Mediator Accreditation Council
(NMAC), the newly formed Mediator Standards Board (MSB), in its task of ensuring that the voluntary regulation of the mediation industry reflects the needs of those who participate within it - Lynne Richards, AIDC Training Manager, 10th National Mediation Conference, Adelaide, 6 – 9 September 2010 Read More
