The Australian Disputes Centre is celebrating its 35th Anniversary in 2021, and on 13 January we are kicking off celebrations with an Anniversary Mediation Training Programme. Sir Laurence Street conducted ACDC’s first course (as we were then known) in January 1986. Over the past 35 years, ADC has trained hundreds of mediators, many of them going on to become Australia’s pre-eminent ADR practitioners. Our Special Guest Speaker for this Anniversary course is the Hon. Terry Sheahan AO, who as NSW Attorney General established ACDC.

In sad news for all in the legal and ADR fields, ADC’s former Chairman, The Hon. Trevor Morling QC has passed away. I first met Trevor nearly 20 years ago. By that time he was one of Australia’s pre-eminent mediators. Trevor retired from the ADC Board in 2012, but he always remained a big supporter of the ADC and would regularly call in to catch up on how things were going for us and Australian ADR more generally. As a distinguished jurist, an eminent international ADR practitioner and one of life’s true gentlemen, Trevor was admired and much loved. I and many others will miss him greatly. Vale Trevor.

NSW Supreme Court ADR Address 2020 The rise of the anti-arbitration injunction The 3rd annual ADR Address of the Supreme Court of NSW was held on 15 October 2020. Our thanks to Chief Justice Tom Bathurst AC in collaborating with the Australian Disputes Centre to present this annual Address. We were honoured to have the Hon. Justice Andrew Bell, President of the Court of Appeal as our esteemed guest speaker, delivering his Address to guests in the Banco Court, together with online attendees across Australia and internationally. Held during Australian Arbitration Week, all were impressed and enlightened by Justice Bell’s insights and discussion on the rise of the anti-arbitration injunction.
Australian Government Consultations International Settlement Agreements Convention on Mediation (ISAC) 12 September marked the entry into force of the United Nations Convention on International Settlement Agreements Resulting from Mediation, (commonly known as the ‘Singapore Convention’). On 7 August 2017, 46 States signed ISAC. Since then, seven more States have signed the Convention for a total of 53 signatories. Six countries have ratified the Convention to date - Singapore, Fiji, Qatar, Saudi Arabia, Belarus and Ecuador.
ISAC is designed to facilitate international trade and commerce by enabling disputing parties to more easily enforce and invoke settlement agreements across borders. By establishing a simplified, uniform framework for the recognition and enforcement of international mediated settlement agreements amongst contracting states, the Convention aims to allow businesses to benefit from mediation as an additional dispute resolution option to litigation and arbitration in settling cross-border disputes. Vale Trevor Morling The Hon Trevor Rees Morling QC The Hon. Trevor Rees Morling QC passed away peacefully at his home on the 2nd of August 2020. He was in his 92nd year.
In addition to a very distinguished legal career Trevor Morling was the Chairman of the Australian Disputes Centre and was for many years a judge of the Federal Court of Australia. He also held commissions as an appeal judge in Tonga, Vanuatu and Western Samoa and was a long‐serving Chairman of the Australian Electoral Commission. After retiring from the Bench, Trevor, always an enthusiastic traveller, was actively engaged as a mediator arbitrator in Europe as well as in Australia.
