As the curtains draw on 2022, the ADC team is reflecting on another big year, and polishing its plans for an exciting year ahead.
Year-end is a great time for us all to look back and reflect on our challenges and achievements. To inspire you, I am delighted to announce that nominations are open for the 7th Annual Australian ADR Awards 2022.
The ADR Awards are an exciting opportunity to recognise your team, your peers and your own outstanding work over the past 12 months. There are 26 ADR Award categories (linked below). I encourage you to start preparing your nomination submissions, due in the New Year.
ADC recently held its final event of the year with The Hon. Robert French AC presenting the 5th annual ADR Address of the Supreme Court of New South Wales - ‘ADR and the Elusive Butterfly of Social Justice.’ What a way to wrap up ADC’s Thought Leadership series for 2022! generous contributions in advancing our understanding of ADR processes and to Chief Justice Andrew Bell for his warm collaboration in hosting this event.
Summer is here, and if you are thinking about how to stay productive despite the summer heat, I encourage you to book training dates in our Sizzling Summer Series with three mediation courses running from Dec 2022 – Feb 2023! ADC is holding its courses online for your convenience (and Covid-safety), and provides participants with a multi-media suite of learning materials to supplement the online interactive experience. Three days of ADC’s 5-day mediation training is in a small group with a professional coach of some 15 – 30 years’ mediation experience. A lot of learning and a lot of fun and camaraderie is yours in this ‘Sizzling Summer Series’. I encourage you to register now as the courses are booking early.
For those who are NMAS Accredited and seeking CPD points, our ever-popular Refresher Training is being held across 6 days, Dec- Jan. I also invite you to register for the ADC Book Club for 2023. This professional Book Club is a fantastic way to ‘stay current’ and ‘build networks’ with like-minded ADR practitioners. I look forward to seeing you there!

Now is the time to take stock, reflect on your, and your team’s achievements in 2022 and be recognised for the extraordinary work that your do. We invite you to celebrate these achievements by:

- Contacting ADC (in early December) with details of those you would prefer to nominate anonymously.

“ADR and the Elusive Butterfly of Social Justice”
|
“This address reflects upon the interaction of alternative dispute resolution in its various manifestations with social justice in its various manifestations and the accompanying benefits and risks. Composing it has been something of a penance for choosing a title first and thinking about the content second. Neither ADR nor social justice is well defined and the content of the latter varies according to the world view of those who use it. Their diverse coverages interact in different ways on individual, societal, transnational and global canvasses. However, some attempt at definitional landscapes if not boundaries must be made in the course of the presentation.” Robert French AC

Mediation Developments in Indonesia

Sonal Okhade and Carol (Xinyu) Liu
Court-annexed mediation is considered more feasible than its voluntary counterpart within Indonesian practice. However, court-annexed mediation is not without its issues. Although it historically has a low success rate, legislative regulation has slightly improved Indonesian mediation practice. This article provides insights on the potential areas of reform to improve the success of court-annexed mediation, including tax reforms and mediator training.

The robotic judge that was once only seen in science fiction films has finally become a reality. The COVID-19 pandemic underlined a greater need for innovation for resolving disputes as humans vacated our court rooms. But with machines potentially more innovative and considerably faster than the human brain, allowing them to operate as judges may pose a threat to the legal system. This article examines the risks and benefits of such technology to evaluate whether it is a threat or a boon.
