It is my sad task to inform our ADC community of the recent death of our friend and colleague Rory O’Moore. Rory was a mediation pioneer and a foundation panellist of ADC. He was well known in the mediation community as an ADR professional, a true gentleman and great friend. Many of you will know or know of Rory. ADC extends to his widow, Helen (and family), our condolences and thoughts. There is a service for Rory between 10.30am–11.30am, Friday, 5 May 2023, at Our Lady Star of the Sea Church at 341 Old South Head Rd, Watsons Bay, for those who may wish to attend.

The 7th Annual Australian ADR Awards have been announced and the ADC team extends its warmest congratulations to all finalists and winners for 2022. Business is resuming as usual at ADC. We are excited to reinvigorate our regular seminar series. We proudly present Med-Arb Practice opportunities in Asia Pacific and welcome the collaboration of the Shanghai International Mediation Centre for this simulcast event. The seminar will be held on 25 May, and we encourage you to join us in Sydney or online and invite your colleagues to an informative session on ADR practice with a global perspective.
I am thrilled to announce that ADC’s flagship mediation training and accreditation programme is being offered online and for the first time, as a hybrid course from sunny Darwin in early August. If you are in the NT, or planning a visit, you can join us in person (or online) for the first 3 days. ADC also has a brilliant Expert Determination training programme in the diary for late September. This is another hybrid event (Sydney/Online) and we are excited for you to be a part of this training initiative.
ADC also offers other opportunities for you to earn CPD points. We are delighted to invite ADR professionals to be a volunteer judge or mediator in the 7th Annual ADC-ICC Asia-Pacific Commercial Mediation Competition this coming 26–28 August 2023. It is a great way to help cultivate future talent in the field, in addition to a chance at participating in exclusive networking events and opportunities.

Co-hosted by the Australian Disputes Centre and the International Chamber of Commerce (ADC-ICC) in partnership with the Good Business Foundation (GBF) and Confederation of Asia-Pacific Chambers of Commerce and Industry (CACCI), APCMC will be held online from 26-28 August 2023.

On 12 April 2023, the High Court of Australia handed down its decision in Kingdom of Spain v Infrastructure Services Luxemburg S.à.r.l. The High Court has largely upheld the previous decisions of the Federal Court by recognising an award issued under the Convention on the Settlement of Investment Disputes between States and Nationals of Other States (ICSID Convention).
This is the first High Court judgment concerning waiver of foreign State immunity under the Foreign States Immunities Act 1985 (Cth) (the Immunities Act) in connection with the recognition of an ICSID arbitral award. The judgment also discusses Australia's interpretation of 'recognition', 'enforcement' and 'execution' under the ICSID Convention, where the interpretation of the latter has remained, until now, ambiguous.
