Dear Colleagues
For years I have highlighted the reality that we work in a growth industry. We all know that conflict is a normal part of life. But recent weeks have confronted us with distressing and heinous responses to conflict; domestic violence and the ceaseless murder of women in Australia, and international violence on a scale so extreme we can barely fathom the depth of misery being endured by millions on its frontlines. And yet our work continues. Assisting people with conflict capability skills and private dispute resolution processes remains a rewarding career for many of you who read this Bulletin; those who are charged with remaining the voice of reason and optimism in many difficult situations. In times of much despair, the voice of optimism is a priceless commodity. Thank you for all the work you do, and your many contributions to making this a better world for us all.
In this Bulletin we seek to bring you a few sources of optimism from different quarters. Firstly, I encourage you to view the broadcast of Attorney General, the Hon. Chancey Paech MLA delivering the recent ADR Address of the Supreme Court of the Northern Territory. He is inspiring and brings the voice of informed optimism to his work. May I also extend a big thank you for the support of First Nations Broadcasting in bringing you this ADR Address - brilliantly filmed and edited!
We are also excited to bring you the ADR Address of the Supreme Court of NSW 2023 and will let you know as soon as a new date is confirmed. For now, we wish our guest speaker, Prof Luke Nottage, a speedy recovery following a cycling accident.

Working with our student interns is a daily source of optimism for me, and hopefully for you when you read Intisar Aslam’s cogent call to arms for the uptake of family law arbitration in India (in the Bulletin below). We can rest easy that brilliant and thoughtful minds are preparing for some stellar careers in ADR across the globe.
We are fast approaching ‘The Season’ for the Australian ADR Awards. This is a time for you to look back with pride on all that you and your team have achieved during 2023. Or maybe you have someone else you think would be a worthy recipient of recognition? We welcome all nominations in 26 categories. Please read the categories linked in the Bulletin and start thinking about those nominees and submissions; nominations are open 5 Dec – 5 Feb 2024.
Looking forward with optimism and a sense of fun, please diarise to join us in Sydney on 21 - 22 March 2024 for the dispute resolution community’s celebration of the year – The Australian ADR Conference and Awards Gala Dinner. We have a lot planned across two sizzling days in Sydney, plus you’ll still have time for a meeting or two and frock-up for the Gala Dinner. Stay tuned for full details, but for now click the Calendar Invite in this Bulletin and Save the Dates!
Many of our major law firms support the Australian ADR Awards and the work of ADC. We are also most grateful to these firms for sharing their Thought Leadership in the sector. In this Bulletin, Allen & Overy present a Case Note on a recent WA Court of Appeal matter.
Stay current, informed, and optimistic that ADC will continue to celebrate excellence in the field of dispute resolution.
Warm Regards, Deborah

8th Annual Australian ADR Awards Gala Dinner – Save the Date
|
This is the night of nights for Australia’s Dispute Resolution Community.
|
The ADR Awards celebrate excellence in the field of dispute resolution. The annual Gala Dinner reflects this celebration and the substantial, yet often unsung, contributions of ADR practitioners to our civil society.
The Gala Dinner attracts artistic talent whose values align with the ethos of the Australian ADR Awards. Previous performances have included the Royal Australian Navy Band, Australia’s iconic Bangarra Dance Theatre and acclaimed didgeridoo performer William Barton. Juxtaposed with internationally celebrated performers, the Gala also draws-in brilliant local community and schools’ choirs to herald guests to dinner.
Dynamism, excitement and meaning are all hallmarks of the Australian ADR Awards night of fun. Coupled with great food and wine, the celebration is high-end and high-impact.

Family Dispute Arbitration in India: A Dual Layer Protecting the Privacy and the Sacred Union
|
Marriage is a sacred union between two spouses in India. It is a sacrament under Indian Hindu Law. It is a social institution: an indissoluble and eternal institution of memories and experiences. However, no marriage is immune to disputes between the two spouses. The only fine line that protects or breaks this union is the line of divorce.
