Australia lays claim to many of the world’s leading ADR experts. A central plank of ADC’s remit is to help promote this expertise internationally. Over the past two months ADC has had a particular focus in the Indo-Pacific and I have been speaking with many hundreds of business leaders, university students and lawyers on Australian dispute resolution.
Back at home, we have been honoured to host two delegations from China’s Ministry of Justice, speaking with ADC on ADR in Australia.
For 10 years a centrepiece of our ‘Starting Young’ program has been a Year 10 Debating Competition. On 30 November we had a brilliant day at ADC hosting 9 schools for a special 10th anniversary edition of this event. Our warm thanks to the Hon. Terry Sheahan AO, Geri Ettinger and Naomi Oreb, Banco Chambers, for so generously supporting the students in adjudicating their Grand Final.
ADC’s year is all but done and it has been another stellar year for us. I now invite you to reflect on your achievements in 2023 and be part of one of the biggest events on the Australian ADR calendar, certainly the biggest party! Yes, it is Australian ADR Awards time again and nomination submissions open today.

If you have a business development manager or an enthusiastic team member, forward this Bulletin to them - with links to the submission forms - to get them on the job early. If it is you who will be writing the submissions, diarise a few hours before Christmas to get your nominations well underway before the holiday break. A note to all that two written references are needed for each submission, so it’s ideal to get those done early. Submissions are due by 15 February. So yes, currently plenty of time, but as we all know, that can race away really quickly.
In an exciting addition to our Australian ADR Awards Gala event we are hosting the inaugural ADR Awards Conference. Please Diarise the Dates: 21 March, Conference and Cocktail Reception, and 22 March ‘Coffee and Connections’ open house at ADC (morning), Gala Dinner (evening) and After Party (late). The theme is “Pure Gold: The Minting of Australian ADR”. Our Bulletin readers are all solid gold and I very much look forward to celebrating with you.

Alternative (or Appropriate/Assisted) Dispute Resolution (ADR) is an umbrella term that includes a range of processes such as mediation, conciliation and arbitration that are used to resolve disputes as an alternative to litigation. Every day many thousands of Australian ADR Professionals help de-escalate conflict, resolve disputes efficiently, promote access to justice, reduce stress, enhance business productivity and limit the financial impact on taxpayers, who fund our Courts and Tribunals. In essence ADR helps us all thrive!

ADC International has been working in the Indo-Pacific for many decades promoting Australian ADR. Over recent months we have been pleased to reconnect with friends and colleagues across the region.
In the Philippines and Nepal, CEO Deborah Lockhart was speaking with business leaders from across the Asia-Pacific region on the benefits of ADR for business success. In northern India, Deborah was speaking with business and law students about ADR and environmental justice and in southern India she was speaking with lawyers from across the region about best practice mediation. ADC are experts in each of these areas, and we are proud to both support and have the backing of our brilliant local practitioners in advancing Australian dispute resolution expertise.

We are thrilled to have taken part in the recent 36th LAWASIA Conference last November 24-27 November 2023, held in the vibrant Bengaluru, Karnataka. It was a great privilege to see one of Australia’s leading jurists in environmental law receive an Honorary LAWASIA Life Membership in the conference inauguration. We congratulate Justice Brian J. Preston FRSN SC on this tremendous occasion.
We also congratulate Mr Shyam Divan for his new role as LAWASIA President, and look forward to greater collaboration across the region.

Visiting Chinese Justice Department Delegations

Judges’ Delegation - Fujian Provincial Higher People’s Court
|
|
In line with ADC’s mission of being an ADR centre of excellence in Australia and internationally, we were privileged to meet with two delegations from the Chinese Ministry of Justice here in Sydney to discuss commercial mediation in Australia and explore the strategies used in conflict resolution.
Delegates from the Justice Bureau of Shenzhen Municipality, led by Mr Hailei Cao, met with ADC director Mr John Wakefield and Ms Susie Zhou on 23 November 2023. On 1 December 2023, the ADC team met with delegates from the Fujian Provincial Higher People’s Court, led by Mr Ou Yanfeng,.
In meeting these important delegations, ADC was honoured to have facilitated a productive discussion on the ADR landscape in Australia and internationally, with a focus on relevant laws, regulations, and current challenges in the field.
We thank John Wakefield and Vivian Chen of Holman Webb Lawyers and Susie Zhou for their support in meeting with the delegates. ADC looks forward to further opportunities to once again collaborate in advancing ADR solutions and education to individuals, communities, and businesses in the wider Asia-Pacific region.

10th Anniversary ADC Schools Debating Competition
|
ADC congratulates the overall Winning Team of the competition, who impressed our esteemed Grand Final judges with their excellent speaking. The members of the winning team included Joohee Um (Tara Anglican School for Girls), Beatrix Fattorini (Burwood Girls’ High School) and Melanie Phan (Baulkham Hills High School). We particularly congratulate Bonnie Zhang (Ravenswood School for Girls) for being both a member of the winning team and the overall Best Speaker of the debating competition. Australia’s New Unfair Contract Terms Regime has commenced – time for head contractors and principals to review and update their contracts for compliance
|
The Treasury Laws Amendment (More Competition, Better Prices) Act 2022 (Cth) significantly broadened the scheme penalising unfair contract terms in the context of standard form consumer and small business contracts. Overall, the new regime potentially optimises the contractual rights and obligations of subcontractors and shifts risk up the contractual chain from subcontractors to head contractors and principles. Sean Marriott and Lydia Low analyse the implications of the new UCT regime and identify key areas where head contractors and principals may need to review and update their contracting practices to remain compliant.

Criminal Justice and Alternative Dispute Resolution
|
Restorative justice and ADR are closely intertwined in offering a range of alternative measures to redirect matters from traditional court proceedings to an environment that encourages collaborative and meaningful discussions among participants to develop a mutually agreed upon outcome. Karen Mak analyses emerging evidence of the benefits that restorative justice interventions may offer to victims, offenders and the community, arguing that while restorative justice may not be appropriate in all circumstances, it is essential that more action is taken to deepen the use of, and access to, ADR-based criminal justice interventions.
